Terms of Service
These Terms are the agreement between you and the operator of WixyChat (the "Service"). They apply to everyone who visits the site, has an account or pays for a plan. The Privacy Policy, the Cookie Policy, Payments and Refunds, the Content Policy and the Safety section on this page are part of the same agreement.
1. Who we are and how to reach us
WixyChat is run by an independent developer, a private individual who does not trade through a company ("we", "us"). Every request reaches us at [email protected].
Write to [email protected] about anything: support, privacy, payments, reports or legal requests. This address is also our single point of contact for users and for public authorities under the EU Digital Services Act. We answer in English or Russian and do our best with the other languages of the site. Copyright notices go to [email protected].
2. Accepting these Terms
You accept these Terms when you pass the age check on entry, sign in, or press "Accept and continue" in the app. We record which version you accepted and when. If you do not agree, do not use the Service. If a translation of these Terms differs from the English text, the English text applies, unless the law of your country gives you more protection.
3. Adults only
You must be at least 18 years old and an adult under the law where you live (if that age is higher, it applies). You may not use the Service where the law forbids it, from the United Kingdom (section 13), or after we have closed an account of yours. Today we rely on your own confirmation of your age. We may ask you to complete an additional age check, and we close accounts we believe belong to a minor.
4. Your account
One account belongs to one person. You sign in with a one-time code sent to your email or through Google, Discord or X, and you may link Telegram. Keep that email and those accounts secure: you are responsible for what happens under your account, and you should tell us at [email protected] if you think someone else has used it. Do not share, sell or transfer an account, and do not open extra accounts to get more free usage or to come back after a ban.
5. What the Service is
WixyChat lets you chat with fictional characters played by AI language models, create your own characters, request pictures and voice in chat, and share characters and comments with other users. There is a free plan and there are paid plans; the subscription page shows what each includes. We keep working on the Service and may change, add or remove features. If a change takes away a main feature of a plan you have already paid for, you may ask for a refund of the unused part of the term.
6. AI-generated output
Every reply, picture and voice in chat is produced by AI models that we do not fully control. Output can be inaccurate, offensive, repetitive or unexpected, and a character may claim to be human or to have feelings as part of the story: it is still a program. Nothing a character says is professional advice of any kind (medical, legal, financial, psychological), and the Service is not an emergency or crisis service. Do not rely on output for decisions about your health, money, safety or legal position. As between you and us, you may use the output of your own chats as you like within the law and these Terms. Other users may receive similar output, and output may not be protected by copyright.
7. Your content and the licence you give us
Your content is what you add to the Service: characters and group cards, personas, messages, uploaded images, comments and profile details. You keep the rights you have in it. To run the Service you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and adapt your content (for example to resize an image, build a preview card or send a chat to the AI provider that writes the reply) and to show it to the people your visibility settings allow. For a public character this means other users can chat with it; if you make its description public, they can also make their own copies (forks), which stay on the Service after you delete yours. We may show your public characters in the catalog, in recommendations and in previews that link back to the Service. The licence ends when you delete the content or your account, except for forks already made, copies we must keep by law, and backups until they expire. You confirm that you have the rights needed for what you upload and that it follows these Terms and the Content Policy; you are responsible for it.
8. Rules of conduct
Do not use the Service to create, request, share or take part in any of the following:
- Sexual or suggestive content involving a minor, or a character who is, looks like or is written as a minor. We report apparent child sexual abuse material to the authorities.
- Content that puts a real, identifiable person into a sexual, degrading or defamatory scene, or that could mislead people about what a real person said or did. Characters based on private individuals are not allowed at all.
- Anything illegal where you are or where we operate, including help with committing a crime.
- Content that praises, incites or teaches real-world violence, terrorism or self-harm.
- Harassment, threats, stalking, doxxing or hate speech aimed at real people or protected groups.
- Malware, attacks on our systems or on other users, and attempts to get around security measures, rate limits or a regional block (for example with a VPN).
- Scraping, bulk downloading, reselling access or reverse engineering the Service, including attempts to extract the platform's hidden instructions.
- Pretending to be WixyChat staff, another user, or any real person or organisation in a way that misleads.
- Spam, false reports, payment fraud, or several accounts used to get around limits.
The Content Policy explains these rules in detail. Breaking them can lead to the measures described in section 14.
9. Plans, credits and payments
Paid plans are prepaid for a fixed term (one, three, six or twelve months, or a year at the annual price) and never renew automatically: when the term ends, your account returns to the free plan unless you buy more time, and nothing is charged again. Credits are a prepaid balance for usage beyond your plan and do not expire. You can pay in cryptocurrency through CryptoPay or NOWPayments, or with a Boosty membership, which Boosty bills under its own terms. Payments and Refunds, below, covers prices, the 14-day right of withdrawal for consumers who have one, and refunds.
10. No sex trafficking or commercial sex
The Service must not be used to promote or facilitate prostitution, sex trafficking or any commercial sexual service, whether real or advertised through a fictional framing (47 U.S.C. § 230(e)(5), the US law known as FOSTA-SESTA). Roleplay on WixyChat is fiction between an adult user and clearly labelled AI characters. An attempt to arrange, advertise or solicit real-world sexual services closes the account at once and, where the law requires, is reported to law enforcement.
11. Your own API keys
You may connect your own key for a supported AI provider. Requests made with it go to that provider under your own agreement with them: you are responsible for following their terms and usage policies (some restrict adult content) and for what they charge you. We store keys encrypted, use a key only for requests you make, and never for anyone else. We are not a party to your agreement with the provider and are not responsible for how the provider handles what you send with your key. Platform features such as memory, pictures and voice still follow your plan.
12. All characters are adults
Every character on the Service must be, and is treated as, an adult aged 18 or older. Characters who are minors, whose adulthood is unclear, or who carry childlike traits in a sexual context are forbidden. Public characters are checked for this before they are published, and the AI instructions behind every chat keep sexual content to adults. Breaking this rule leads to removal of the content and closure of the account.
13. Where the Service is available
The Service is not offered in the United Kingdom, and access from the UK is blocked. Do not use a VPN or other tools to get around this or any other regional block. We may limit the Service, or adult content, in other countries or regions when we cannot meet their legal requirements. You are responsible for following the law of the place where you use the Service.
14. How we moderate and enforce these Terms
An automated AI review checks public characters against our rules before they are published, picture requests are screened against the same rules, and reports from users and others are reviewed by a person; every suspension or closure of an account is decided by a person. We may remove content or limit who sees it, freeze chats with a removed character, limit features, or suspend or close an account. We usually warn first, but we act at once for content involving minors, intimate images shared without consent, credible threats, fraud and other serious cases. When we act against your content or account, we tell you what we did and why, unless the law forbids it. You can contest a decision within six months by replying to our message or writing to [email protected], and a person will review it.
15. Ending the agreement
You can stop using the Service and delete your account at any time in Settings. We may suspend or close your account for a serious or repeated breach of these Terms, when the law requires it, or to protect other people or the Service; in that case unused prepaid time and credits are not refunded unless the law says otherwise. If we close your account without such a reason, or shut the Service down, we give you at least 30 days' notice where we can and refund the unused part of your prepaid term and your unspent credits. The Privacy Policy explains what happens to your data after deletion.
16. What we promise and what we do not
We run the Service with reasonable care and skill, but AI output is unpredictable and the Service may at times be unavailable, slow or wrong. Apart from what the law guarantees and does not allow us to exclude, the Service is provided "as is" and "as available", without other warranties, express or implied, including fitness for a particular purpose and uninterrupted availability. If you are a consumer, nothing in these Terms limits your statutory rights, including your rights when a digital service does not match the contract.
17. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or revenue, or loss of data, and our total liability for all claims connected with the Service is limited to the amount you paid us in the twelve months before the claim, or USD 50 if that is more. These limits do not apply where the law does not allow liability to be limited, such as for death or personal injury caused by negligence, for fraud, or for damage caused intentionally or by gross negligence.
18. Claims caused by your content
If someone brings a claim against us because of content you posted, or because you broke these Terms or the law, you cover the reasonable losses and costs this causes us, to the extent the law allows. This section does not apply to a consumer where the law of their country forbids such a term.
19. Changes to these Terms
We may update these Terms, for example when the Service or the law changes. Every version is dated and stored. Before a material change takes effect we tell you in the app and by email, at least 14 days in advance unless the change is required by law, is needed for safety, or only adds to your rights, and we ask you to accept the new version before you continue. If you do not accept it, you can delete your account, and we refund the unused part of your prepaid term and your unspent credits.
20. Governing law and disputes
If something goes wrong, write to [email protected] first: most problems are solved that way, and we answer within 30 days. These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you may bring a claim before the courts of that country.
21. Other terms
If a court finds part of these Terms invalid, the rest stays in force. If we do not enforce a right straight away, we have not given it up. We may transfer this agreement to a company that takes over the Service, for example one the founder sets up to run it; your rights under these Terms stay the same and we will tell you. You may not transfer your rights under these Terms to anyone else. These Terms and the documents they refer to are the whole agreement between you and us about the Service.
Privacy Policy
What personal data WixyChat collects, why, who else receives it, how long we keep it and what rights you have. It applies to visitors, account holders and anyone who contacts us. We do not sell personal data, we show no ads, and we do not use your chats to train AI models.
1. Who is responsible
WixyChat is run by an independent developer, a private individual who does not trade through a company ("we", "us"). Every request reaches us at [email protected].
The operator named in section 1 of the Terms is the controller of your personal data. Write to [email protected] with "Privacy" in the subject for any question or request about your data. We have not appointed a data protection officer.
2. What we collect
We collect what you give us, what the Service creates for you, and a little technical data:
- Account: your email address, display name, interface language, how you sign in (a one-time code, or Google, Discord or X, matched by email; we do not store the provider's account ID), your Telegram ID and username if you link Telegram, and the campaign tags of the link that brought you (such as utm tags or an ad click ID) when you sign up.
- Confirmations: when you passed the age check, accepted the Terms or turned on adult content, with the version, time, IP address and browser at that moment.
- Profile and community: avatar, banner, tagline, bio, links, characters you pin, the authors you follow or block, and the characters and posts you favourite, rate or like.
- Content: characters and group cards, personas, chats (your messages, the replies, alternative replies and the summaries that serve as chat memory), voice messages you record with their transcripts, pictures and voice replies generated in your chats, comments (stored with the IP address and browser they were sent from), and reports or support messages you send (with your email, IP address and browser).
- Payments: your plan and its dates, invoices (amount, currency, status, payment provider, the provider's reference and payment link), credits and a usage log with the cost of each request. We never receive card numbers or wallet keys and do not store your wallet address.
- Your own API keys, if you add them, stored encrypted.
- Technical data: your IP address (used for security, rate limits and the regional block, and stored only in the records listed above), browser type, error reports and server logs.
3. Sensitive information in chats
Roleplay chats can reveal things about your sex life, sexual orientation or health. We process this information only to run the chats you ask for, on the basis of your explicit consent: you give it when you turn on adult content and when you choose to write such things. You can withdraw it at any time by turning adult content off and deleting the chats concerned or your account. We never use chat content for advertising or profiling. Please do not put real names, addresses or other details that identify you or other people into chats.
4. Why we use it and on what legal basis
Under the GDPR each use needs a legal basis:
- To run your account and the features you use (chats, characters, pictures, voice, sharing, notifications and the emails the Service sends): performance of our contract with you.
- To process payments, activate plans and keep payment records: performance of the contract and our legal obligations under tax and accounting law.
- To keep proof of age confirmations, accepted Terms and adult-content consent: our legal obligations and our legitimate interest in showing that we follow the rules.
- To keep the Service safe: moderation of public content, the crisis notice described in the Safety section, abuse and fraud prevention, rate limits and the regional block. Legal basis: our legitimate interests and, where the law requires us to act, legal obligations.
- To understand how the Service is used: cookieless visit counts, plus usage events tied to an internal account ID (such as sign-up, first chat or a payment, with your plan, language and campaign tags, never your email, name, IP address or chat text). Legal basis: our legitimate interest in improving the Service; you can object at any time.
- To learn which links and ads bring people to the Service: the campaign tags (utm tags), the ad click ID and the landing page of the link you arrived through are held in the page's memory (no cookie or browser storage) and saved with your account when you sign up; the campaign tags, never the click ID, also go to our analytics. They are deleted with your account. Legal basis: our legitimate interest in measuring our advertising; you can object. We do not send the click ID back to ad networks today; if we start telling a network that its click led to a sign-up or a payment, it will receive only its own click ID, and we will update this policy before that starts.
- To send product news by email: our legitimate interest, with an opt-out in your notification settings and in every news email.
- To answer legal requests, enforce our Terms and defend legal claims: legal obligations and our legitimate interests.
5. How AI providers receive your chats
To write a reply, we send the AI provider what the model needs: the character card, your persona, recent messages, the chat's summaries and your new message. We do not send your email, account ID or IP address. Chat models are reached through OpenRouter, which passes the request to the company hosting the model you picked (for example Google, DeepSeek, Anthropic, OpenAI, Mistral or xAI). Some of these hosts keep requests for a limited time to detect abuse, and a few may use them to improve their models under their own policies; OpenRouter publishes each host's policy. If you use your own API key, the request goes to that provider under your agreement with them. Pictures are made by Runware from a scene description that contains no names or account data. Voice replies are made, and voice messages transcribed, by DeepInfra, which receives only the text or the recording. Public characters are checked by an AI model (Google Gemini, reached through OpenRouter), which receives only the character's text.
6. Who at WixyChat sees your data
Only the operator has access to the systems that store your data. The admin panel has no chat viewer. We look at a chat only when we need to investigate a report about it, when you ask us to look into a problem, or when the law requires it. Moderators see public characters, comments and profiles as any user does, and can also open private characters.
7. Service providers and other recipients
These companies process data for us, under their terms for business customers, only to provide their service:
- Hetzner Online (Germany): servers and databases, located in Finland and Germany.
- Cloudflare (USA, EU storage): delivers and protects the site, routes email sent to our addresses, and stores images, voice files and encrypted database backups in the EU (R2).
- OpenRouter (USA) and the model hosts it routes to, DeepInfra (USA) and Runware (USA): AI replies, pictures, voice and transcription, as described in section 5.
- Resend (USA, sending through Amazon Web Services in Ireland): the emails the Service sends.
- Google (Gmail) and Apple (iCloud): mailboxes where messages to our addresses arrive.
- Laravel Nightwatch (performance and error monitoring of our server, which receives your account ID and display name with the requests you make) and Sentry (EU servers: error reports from your browser, sent without your account details).
- PostHog (EU servers): the analytics described in section 4.
- GeoJS: looks up the country of your IP address to apply the UK block.
- Telegram: delivers our internal alerts (for example about urgent reports) and the messages you send to our support bot.
Some recipients act on their own account: payment providers (CryptoPay and NOWPayments for crypto, Boosty for memberships), the sign-in services you choose (Google, Discord, X, Telegram), and authorities or organisations we must report to, such as NCMEC for child sexual abuse material or law enforcement with valid legal process. If the Service is transferred to a company that takes it over, your data goes with it under this policy.
8. International transfers
Our servers and storage are in the EU, but some providers above are in the USA, model hosts may be in other countries (including China for some models), and the operator works remotely from outside the EU. Where a country has no EU adequacy decision, we rely on the EU-US Data Privacy Framework for certified providers and on the standard contractual clauses in our providers' terms. A model host in another country receives your chat only when you pick a model it serves.
9. How long we keep data
We keep data only as long as we need it:
- Account, profile, characters and chats: until you delete them or your account. Messages you delete from a chat disappear at once and are erased from the database when the chat is deleted.
- When you delete your account, your account record, personas, chats, characters, images, voice files and saved API keys are deleted. A published character leaves an empty placeholder with only its name, so other people's chats keep a name for it. Comments you posted stay visible without your name; delete them first if you want them gone. Deleted data leaves our backups within 30 days.
- Usage and AI request logs: 24 months. Server logs: 14 days. Error and analytics data: as long as the provider's plan keeps it.
- Reports: 24 months after they are closed. Reports about child sexual abuse material or intimate images shared without consent are kept longer, as evidence for as long as the law requires or allows.
- Records of the confirmations you gave (time, IP address, browser): kept as proof, also after the account is deleted.
- Payment records: deleted with your account. The payment providers keep their own records under their own rules.
- Data export files: 7 days.
10. Your rights
Wherever you live, you can ask us to show, correct or delete your data. If the GDPR applies to you (in the EU and the EEA), you have these rights:
- Access: a copy of your data. Settings, Privacy and data builds an export of your profile, chats, characters, payments and more; ask us for anything it does not cover.
- Correction of inaccurate data, most of it directly in Settings.
- Erasure: delete chats one by one, all chat history, or your whole account in Settings.
- Restriction of processing while a complaint is being looked at.
- Portability: the export is a machine-readable JSON file.
- Objection to processing based on our legitimate interests, including the analytics events.
- Withdrawal of consent at any time, for example by turning adult content off.
- A complaint to the data protection authority of the country where you live or work.
Write to [email protected] from your account email so we can confirm the request is yours. We answer within one month.
11. Automated decisions
An AI model checks public characters against the Content Policy before they are published. If it refuses a character, you can edit it, or ask for a person to review it. We do not make decisions with legal or similarly significant effects about you by automated means alone, and we do not profile you for advertising.
12. US state privacy laws
We do not sell or share personal information for cross-context behavioural advertising, and we do not use sensitive information to infer characteristics about you. Residents of any US state can ask us to access, correct or delete their data, and we will not treat you differently for doing so. Health information: chats may contain information about your physical or mental health that you choose to write (consumer health data under the laws of Washington and Nevada). We use it only to provide the chats you ask for, and it reaches only the AI providers in section 5 for that purpose. You can delete it with the chat or your account.
13. Children
WixyChat is only for adults. We do not knowingly collect data from anyone under 18. If we learn that an account belongs to a minor, we close it and delete its data; if you know of one, tell us at [email protected].
14. Security
Connections are encrypted (TLS), saved API keys and data exports are encrypted, backups are encrypted before they leave our servers, and access to the systems is limited to the operator. No system is perfectly secure; if a breach puts your data at risk, we will tell you and the authorities as the law requires.
15. Changes to this policy
We will announce material changes in the app and by email before they apply. The date at the top of this page shows the current version.
Payments and Refunds
How plans and credits are paid for, when you can get your money back, and how to ask. If you live in the EU or in another country whose law gives you more rights, those rights apply in addition to what is written here.
1. Plans and terms
A plan gives you a monthly usage allowance and the features listed on the subscription page. Monthly prices are sold for one, three, six or twelve months at once; the annual price buys a year. Buying the same plan again adds the time to the end of your current term. A different plan starts its own term on the day you pay, and the highest active plan is the one you get; time left on a cheaper plan keeps running alongside it and is not converted or credited. A plan below the one you have already paid for cannot be bought, and you cannot prepay more than 24 months ahead. A promo code discounts one billing period. Plans never renew automatically.
2. Credits
Credits are a prepaid balance shown in US dollars. They are used only after your plan allowance runs out, at our rates for the model you use (each model is labelled with a cost tier), and they never expire. Credits are not money: they cannot be moved to another account or exchanged for cash, except as a refund described below.
3. Prices
Prices are shown in US dollars, and in rubles on Boosty. The price at checkout is the full amount you pay us; fees charged by your wallet, exchange or network are yours. Prices for future purchases may change, but a change never affects time you have already paid for.
4. Paying with cryptocurrency
Crypto payments go through CryptoPay (Crypto Bot in Telegram) or NOWPayments. Your plan or credits are activated once the provider confirms the payment as complete. Pay the exact amount on the network shown on the invoice: an underpayment leaves the order pending, and coins sent on another network may be lost or converted. If something goes wrong, write to [email protected] with the invoice details and we will sort it out with the provider. A crypto payment cannot be reversed by a bank; any refund we owe is sent as a new transfer (section 8).
5. Paying through Boosty
A Boosty membership is bought and billed on Boosty under Boosty's terms. While the membership is active and your Telegram account is linked, your WixyChat plan stays active; it ends a few days after the membership does. Cancel the membership on Boosty. Refunds of Boosty payments follow Boosty's rules, and we help where we can.
6. Right of withdrawal
If you are a consumer in the EU or the EEA, you can withdraw from a purchase within 14 days of paying, without giving a reason. By paying for a plan you ask us to start it straight away. If you then withdraw, we refund the price minus the value of what you have already received, measured as the larger of two shares: the part of the term that has passed and the part of the plan allowance you have used. For credits, we refund the part you have not spent. To withdraw, send a clear statement to [email protected] from your account email before the 14 days end, for example: "I withdraw from my purchase of [plan or credits] paid on [date], account [email]." Consumers in other countries whose law gives a similar right can use it on the same terms.
7. Other refunds
Outside the withdrawal period, payments are not refunded for time or credits you did not use, with these exceptions: we refund duplicate or mistaken payments and payments for a plan we could not activate, and we refund the unused part of a term when we close your account without cause, shut the Service down, or take away a main feature of a paid plan (Terms, sections 5, 15 and 19). When a reply, picture or voice fails because of an error on our side, its cost goes back to your allowance automatically. Nothing here limits your rights under the law when the Service does not work as promised.
8. How refunds are paid
We pay a refund within 14 days of agreeing to it, and a withdrawal refund within 14 days of your notice. Crypto refunds go to a wallet address you give us, in the coin you paid with (or in USDT if you agree), for the US dollar value of the refund, and we pay the network fee. Boosty payments are refunded through Boosty.
9. Cancelling
Plans never renew, so there is nothing to stop. Cancelling on the billing page only turns off the expiry reminder: you keep full access until the end of the paid term. Cancelling alone does not refund the days left; sections 6 and 7 say when you get money back.
10. Questions about payments
Write to [email protected] with your account email and the invoice ID or the payment details.
Content Policy
The rules for everything people create and share on WixyChat: characters, group cards, personas, pictures, comments, profiles and what is written in chats. It also explains how to report content and how we handle reports.
1. Fiction, with limits
Characters and stories on WixyChat are fiction generated with AI. Fiction can be dark, intense or explicit for adults who choose it, but some things are not allowed in any context, private chats included.
2. Never allowed
We remove the following wherever we find it and close the accounts behind serious or repeated cases:
- Sexual or suggestive content involving minors, or characters who are, look like or are written as minors (through a stated age, a school setting, age play or childlike descriptions). Zero tolerance: we close the account and report apparent child sexual abuse material to NCMEC or the relevant authority.
- Characters, pictures or scenes that put a real, identifiable person into sexual, degrading or defamatory content, intimate images of real people, and characters based on private individuals. Public figures may appear only in clearly fictional, non-sexual stories that do not mislead anyone about what they really said or did.
- Sexual violence shown as desirable, rewarded or without consequence in public characters or pictures, and anything that encourages sexual violence against real people.
- Sexual content involving characters presented as family members, animals, the dead, or bodily waste.
- Gore or torture for its own sake, with no story around it, and content that praises, incites or teaches real-world violence, terrorism or mass harm.
- Hate speech, slurs, and content that dehumanises people for their race, ethnicity, religion, gender, sexual orientation, disability or similar characteristics.
- Harassment, bullying, threats, stalking or doxxing of real people.
- Content that helps with real-world crime, such as drug or weapon making, fraud or human trafficking.
- Content that encourages suicide, self-harm or eating disorders, or describes methods.
- Content that infringes someone else's copyright, trademark or other rights; we remove it when the rights holder sends a valid notice (section 8).
- Malware, phishing, spam and advertising, and cards built to override the platform's safety instructions.
3. Adult content
Explicit content between adult characters is allowed in characters marked NSFW, for users who have turned adult content on after confirming they are 18 or older. Mark every character with adult themes as NSFW; a wrongly marked character is rejected or relabelled. NSFW characters are hidden from catalog listings for visitors who are not signed in and for accounts with adult content off. Everything in section 2 stays forbidden in adult content.
4. Pictures and voice
Pictures in chat are generated by AI from a written scene description, never from a real person's photo or name, and requests for minors or real people are refused. Do not upload a photo of a real person as an avatar unless you have the rights and the person's consent, and never in a sexual context. Voice replies use synthetic voices from our library; cloning a real person's voice is not offered.
5. How we moderate
Before a character goes public, an automated AI review checks it against these rules; a rejected character can be edited and sent again, or you can ask for a person to review it. The AI instructions behind every chat keep sexual content to adults and away from real people. Reports are reviewed by a person, with child safety and intimate images first. Depending on the case we remove or hide content, freeze chats with a removed character, limit features, or suspend or close the account, and we tell the author what we did and which rule it was based on (Terms, section 14).
6. Reporting content
Anyone can report content, with or without an account. Use the Report button on a character, a comment or a profile, the "Report content" link at the bottom of every page, or write to [email protected]. To let us act quickly, include: the exact link or ID of the content; why you think it is illegal or breaks this policy (and under which law, if you can say); your name and email address (the form asks for an email so that we can follow up); and a statement that the report is accurate to the best of your knowledge. If you leave an email, we confirm that we received the report and tell you what we decided. Never send us copies of illegal images: a link is enough.
7. If you disagree with a decision
If we removed or restricted your content or account, or did not act on your report, you can ask us to look again within six months: reply to our message or write to [email protected]. A person reviews the case and we reply with the outcome. A character rejected by the automated review can be edited and resubmitted at any time.
8. Copyright complaints (DMCA)
If you believe content on WixyChat infringes your copyright, send a notice to our copyright agent at [email protected] with: (a) the copyrighted work; (b) the material you consider infringing and where it is (link or character ID); (c) your contact details; (d) a statement that you believe in good faith the use is not authorised by the owner, its agent or the law; (e) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or may act for them; (f) your physical or electronic signature. We remove or disable the material promptly and tell the uploader. The uploader may answer with a counter-notice to the same address, giving their contact details, the removed material and where it was, a statement under penalty of perjury that it was removed by mistake or misidentification, their consent to the jurisdiction of the US federal court for their address (or, outside the US, of any judicial district where we may be found), and a signature. We forward the counter-notice to the complainant and restore the material after 10 to 14 business days unless they tell us they have gone to court. Accounts of repeat infringers are closed after the third valid notice.
9. Intimate images shared without consent
Intimate images of real people are not allowed on WixyChat. If an intimate image of you, real or AI-generated, appears on the Service without your consent, you or someone acting for you can ask us to remove it, with or without an account: use the Report button with the reason "Non-consensual sexual content", or email [email protected]. Include your name and signature (typing your full name is enough), the link or enough detail to find the image, a short statement that you did not consent to its publication, and a way to contact you. We remove the image within 48 hours of a valid request and make reasonable efforts to remove known identical copies, as the US TAKE IT DOWN Act requires.
10. Child safety and law enforcement
We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and keep the evidence for as long as the law requires. When information we find suggests a threat to someone's life or safety, we inform the competent authorities. We answer requests from law enforcement that come with valid legal process; send them to [email protected].
AI Disclosure and Safety Protocol
How WixyChat tells you that you are talking to an AI, and what happens when a message suggests someone may be at risk. We publish this protocol as California law (SB 243) requires of companion chatbot services.
1. You are talking to an AI
Every character on WixyChat is played by an AI model, not by a person, even when the story says otherwise. The chat screen shows a notice saying so when you start chatting and again after every three hours of continued chatting, and pages with AI-generated content carry a machine-readable label.
2. Not for minors
AI companion chatbots may not be suitable for some minors. WixyChat is for adults only: we do not knowingly let anyone under 18 use it, and we close accounts we believe belong to a minor.
3. Suicide and self-harm protocol
When a message you send states an intention to end your life or to hurt yourself, the chat shows a notice with crisis services: findahelpline.com for helplines in your country and, in the US and Canada, the 988 Suicide and Crisis Lifeline (call or text 988). The notice does not block the chat or change your message. The check looks for explicit first-person statements and is built to ignore ordinary story violence; it works in all eight languages of the site. The AI instructions behind every chat forbid describing methods of self-harm, and characters that encourage suicide, self-harm or eating disorders are not allowed and are removed. The result of the check is not stored in your profile or sent to analytics.
4. If you are in danger
WixyChat cannot help in an emergency. If you or someone else is in immediate danger, call your local emergency number. If you are struggling, a helpline can talk with you now, for free: findahelpline.com lists them by country.
18 U.S.C. § 2257 Exemption Statement
Why the US record-keeping rules for sexually explicit material do not apply to WixyChat.
1. No real people in explicit content
WixyChat does not produce or host visual depictions of real people engaged in actual or simulated sexually explicit conduct. Sexually explicit pictures on the Service are generated by AI and show fictional characters only; uploading a photograph of a real person in such a context is forbidden and removed.
2. How content is made
Chat replies are written in real time by AI language models, and pictures are generated by AI image models from text descriptions. None of them is based on recordings of real performers.
3. Fictional adults only
Every character is an adult aged 18 or older within the fiction. Any resemblance of a fictional character to a real person is unintended, and characters that put real people into sexual content are forbidden.
4. Non-applicability of 18 U.S.C. § 2257
Because no sexually explicit visual depiction on the Service shows a real person, the record-keeping and labelling requirements of 18 U.S.C. § 2257, § 2257A and 28 C.F.R. Part 75 do not apply to WixyChat. This statement is made in good faith for transparency.
